The Ministry of Youth and Sports of Ukraine has spoken out against the annulment of marriages involving trans people who have legally transitioned. The provision violates the Constitution of Ukraine.
The Ministry did not support a discriminatory provision in the draft of the new Civil Code (No. 15150). This refers to a provision that proposes declaring marriages invalid if either spouse has changed their gender marker in official documents. Additionally, under the new Civil Code, an “interested party” who is not a spouse may file a petition to annul a marriage record.
The Ministry of Youth and Sports emphasized that such provisions violate the Constitution of Ukraine and international treaties. The Ministry called for a revision of the bill to ensure human rights and respect for human dignity, the principles of equality and non-discrimination, and the right to marriage and family. The conclusion accordingly cites Articles 21, 24, and 28 of the Constitution of Ukraine, as well as Article 14 of the Convention for the Protection of Human Rights and Fundamental Freedoms.
